Terms of Service
The rules that apply when you use the alturys.dev website and when you work with us. They are written to be understood on first reading.
01Service provider
The alturys.dev website and the services presented on it are provided by Guilherme André Cabral, a sole trader (self-employed professional registered with the Portuguese Tax and Customs Authority), trading under the brand name Alturys, with activity registered under CAE 62010 (Computer programming activities) and based in Portugal. Throughout these terms, “Alturys”, “we”, “us” or “the provider” refer to this professional.
For any legal, contractual or privacy matter, please write to [email protected]. The Portuguese tax identification number (NIF) is not published on this page, but will be provided to anyone who requests it by email, for example for invoicing or verification purposes.
02Purpose and scope
These terms govern the use of the alturys.dev website and set out, in general terms, the framework for the services provided under the Alturys brand. By browsing the website or engaging a service, you accept the rules described here.
Each project is formalised by means of its own contract. In the event of any conflict between these terms and a signed contract, whatever has been agreed in writing for that project shall prevail.
The processing of personal data associated with the website is described in the Privacy Policy, and the cookies used are documented in the Cookie Policy.
03Services provided
The following services are provided under the Alturys brand:
- Bespoke websites: design and development of websites built from scratch for each business.
- Process automation: connecting tools and building workflows that remove repetitive manual work.
- AI chatbots: conversational assistants that reply in writing to customers and leads.
- AI voice agents: systems that answer and handle telephone calls automatically.
- Visual identity and rebranding: creating or refreshing a brand's visual identity.
- Paid advertising: management of advertising campaigns on digital platforms.
The specific scope of each service is defined in the contract for each project.
04Proposals and contracts
Every project begins with a discovery call, in which we seek to understand how your business works and whether it makes sense to proceed. Where it does, the proposal is presented verbally during that call, with the scope and fees set out.
Once the proposal is accepted, a written contract is sent setting out everything in detail: the services to be provided, the fees and payment terms, the deadlines, the obligations and duties of each party, and any other information required by law. It is that contract, once signed, that defines the commitment between the parties and that prevails over these terms in the event of any discrepancy.
Work not included in the signed contract is treated as an additional request, to be quoted and contracted separately.
05Payment and invoicing
Invoicing is carried out in the capacity of a self-employed professional, with the issue of the tax documents required by law (an electronic invoice or invoice-receipt).
Payment terms (amounts, instalments and dates) are defined in the contract for each project and must be met at the times provided for therein.
Late payment of any instalment may lead to the suspension of work in progress until payment is made, with a corresponding adjustment to the project schedule.
06Timescales and delivery
The deadlines agreed in the contract are taken seriously and the work is planned to meet them.
Delivery depends, at various stages, on items that only the client can provide: content, access to accounts and platforms, approvals and feedback. Deadlines assume that these items arrive on the agreed dates.
Delays attributable to the client (for example, missing content or pending approvals) shift the project schedule by the same amount, without this constituting a breach by the provider.
07Client obligations
By engaging a service, you undertake to:
- Provide the content, materials and access needed to carry out the work, within the agreed timescales.
- Ensure that you hold the necessary rights to the materials you supply (text, images, logos, databases or other materials), and accept liability for third-party claims relating to those materials.
- Provide feedback and approve deliverables in good time, so that the project progresses according to the planned schedule.
08Intellectual property
Upon payment in full for the project, the client receives the rights to use the final work agreed in the contract (for example, the website, the visual identity or the automation delivered).
The provider retains ownership of the tools, libraries, reusable components and general know-how used in carrying out the work, which may be used again in other projects.
Unless otherwise agreed in writing, the provider may reference the project in the portfolio and in presentation materials for the Alturys brand.
09Warranties and liability
The services are provided with the professional diligence appropriate to the field. Defects reported in the work delivered are corrected within a reasonable time and at no additional cost, provided they fall within the scope agreed in the contract.
The provider's liability for damage arising from a service is limited to the amount actually paid by the client for that service. No liability is accepted for loss of profit, loss of revenue or other indirect damage.
Third-party services used in projects (hosting, domains, advertising platforms, APIs or others) are governed by the terms and availability of those third parties. The provider does not control or guarantee the operation of those platforms.
10Use of the website
The content of the alturys.dev website (text, images, illustrations and code) is provided for information and is the property of the provider, unless stated otherwise. It may not be copied or reproduced for commercial purposes without permission.
It is likewise prohibited to scrape the website abusively, to overload it deliberately or to attempt to compromise its security or that of the infrastructure serving it.
The website may be temporarily unavailable for maintenance or updates. Personal data collected through the website, including data from meeting bookings, is processed in accordance with the Privacy Policy; the cookies used are described in the Cookie Policy.
11Disputes and governing law
These terms are governed by Portuguese law.
In consumer disputes, you may refer the matter to an alternative dispute resolution (ADR) entity, under Law No. 144/2015 of 8 September (the Portuguese law on consumer ADR). Information on the available entities can be found at www.consumidor.gov.pt.
Any matters not resolved by agreement or by alternative means fall within the jurisdiction of the Portuguese courts.
12Changes to these terms
These terms may be revised whenever the services, the law or the operation of the website so require. The date of the version in force is always shown at the top of this page.
Material changes do not apply retroactively: contracts already signed remain governed by the terms in force on the date of signature.
If you continue to use the website after a revision, you are deemed to accept the updated version. If in doubt, please write to [email protected].
